Disclosure at lease signing

Read the lease file first if you own a pre-1978 unit. Each lease, new or changed, needs the EPA pamphlet, a lead warning clause and a statement of anything you know about lead paint, hazards or earlier reports, as CDPH notes. The exceptions are short leases of 100 days or less, no-bedroom units and buildings dated 1978 or later.

Turnover repairs and repainting

Between tenants, a landlord who pays someone to patch, sand and paint a pre-1978 unit is working under the EPA renovation rule, which names rental owners and managers. Certification is required for the firm and the renovator. Small jobs of 6 square feet or less per room inside, or 20 outside, are minor repair and fall outside it.

City inspection and code notices

Hayward’s Residential Rental Inspection Program has run since 1989 and covers all rental housing units, checking them against codes and State Housing Standards. A tenant, an owner or the city can start an inspection. Its page does not mention lead. Separately, State Housing Law lets enforcement agencies order a lead hazard abated, and after any notice a certified risk assessment is a sensible first step.

Certified lead-free units

No lead-based paint found by a certified inspector means no federal disclosure for that unit. If lead is found, the report becomes what tenants receive, which beats saying the paint was never checked.

County resources for property owners

Alameda County’s Healthy Homes Department publishes a quick guide to which lead rules apply to rental owners and managers, plus advice on hiring a lead-safe contractor. Its pages for rental housing providers are written around Alameda, Berkeley, Emeryville and Oakland, so ask the department what it offers for a Hayward property. A lead hazard repair grant program also exists; whether a rental qualifies is for the department to say.
